Comunicación a un disconforme

Las Administradoras de KPMG han dirigido hoy una comunicación a uno de los clientes que expresamente indicaron su disconformidad a la liquidación presentada a fecha de 30 de marzo porque reclamaba las pérdidas generadas por el cierre forzoso de las posiciones abiertas.

El texto en inglés está más abajo y en resumen indican que son incapaces, por desgracia, de compensar por el cierre de las posiciones abiertas. Después de discusiones con la FSA (el regulador británico) decidieron cerrar todas las posiciones abiertas para asegurar un trato equitativo a todos los clientes, de acuerdo con los términos del contrato entre Worldspreads y los clientes y después de realizar consultas legales al respecto. Por otro lado tampoco consideran las reclamaciones por ganancias no realizadas.

Hacen mención a que los fondos en posesión por Worldspreads no son suficientes para pagar a todos los clientes y que el Fondo de Compensación pagará hasta 50,000 libras a cada cliente particular y que es probable que los que tenían una cantidad superior no cobren la totalidad de sus fondos.

Por último le piden que confirme si presta su conformidad a la liquidación de fceha 30 de marzo o si no quiere hacerlo, lo exprese por el enlace que le detallan, indicando las razones de la disconformidad y aportando cualquier prueba a su favor.

El cliente en cuestión está planteándose si expresar su conformidad en los siguientes términos: "Expreso mi conformidad a esta liquidación a los efectos exclusivos de que me devuelvan dichos fondos a la mayor brevedad, sin perjuicio de y sin renunciar a cualquier acción legal para reclamar las cantidades que considero me son adeudadas por encima de la liquidación presentada."

Unfortunately we are unable to compensate for the closure of opening positions.

As you will be aware, following the discovery of accounting irregularities on 16 March 2012, the Company was unable to trade due to a substantial deficit in the client money balances, and would not have been permitted to continue trading by the FSA.  Following the Joint Special Administrators' appointment on 18 March 2012, and after discussions with the FSA, the Joint Special Administrators concluded that it was appropriate to close transactions with clients in accordance with the terms of the customer agreements between WorldSpreads Limited and each client.  Accordingly, in order to ensure that all clients were treated equally, immediately upon appointment the Special Administrators closed out positions using the closing prices at close of business 16 March 2012.

Following legal advice, the special administrators closed out all client positions at the appropriate WorldSpreads bid or offer price.  In all cases these prices would have differed slightly from the mid prices.  The transaction adjustments shown on your 30 March statement reflect the write-back of the extra spread which WorldSpreads normally charged as a commission over and above the bid-offer spread it applied.

Accordingly, the prices applied to your WorldSpreads statement dated 30 March 2012 reflect the appropriate bid or offer price and therefore are the correct closing balances.

Claims for unrealised profits are not capable of being claimed in the administration.  The total funds available in the Special Administration are currently estimated to be insufficient to pay clients and creditors in full. As you are aware, the FSCS will pay out amounts up to £50,000 for retail customers, however not all clients held less than £50,000. Those clients that held more than £50,000 are unlikely to be paid in full.

Please confirm to us if you now agree with your statement dated 30 March 2012 by replying to this email with "I agree with my final balance as at 30 March 2012" and provide your full name and address as it appears on your statement.
